1. Introduction
1.1 Algoboost (Proprietary) Limited, registration number 2021/658109/07 (“we”, “us” and “our”) is a private company established in the Republic of South Africa. We are committed to respecting your privacy. This privacy policy describes how we collect, use and process your personal data when you use the Algoboost.ai platform (the "Platform "). This privacy policy applies when you access, use or upload any data to the Platform. Please take the time to read and understand this privacy policy.
2. What is personal data?
We are responsible for ensuring that your personal data is used in compliance with data protection law. Personal data is information which, on its own or in combination with other information, can be used to identify you or others. Personal data may include:
2.1. "Name and contact details": We may collect details concerning your identity, such as your name, surname, email address, physical address and other contact information;
2.2 . “Access Device and Access Device event information”: We may collect information such as your IP address, unique device identifier, the nature of the devices ("Access Device") that you use to access or use the Platform (e.g. a laptop, desktop computer, tablet or smart phone, and which type thereof), the geographic location from which you accessed or used the Platform (i.e. the geographic location of your Access Device), hardware model and settings, operating system type and version, browser language, system activity, crashes;
2.3. “log information”: When you access or use the Platform, we may automatically collect and store certain information in server logs (i.e. our web servers automatically record and maintain a log of you activities), which may include your “activity information”, such as details of how, when and for how long you accessed the Platforms, what features you utilised, what content you accessed, the amount of content viewed, the frequency that you viewed content, the order or sequence in which you viewed content, and the amount of time spent on the specific content.
2.4. “location information”: We may use various technologies to determine your actual location, such as geographical data from your Access Device (which is usually based on the IP location);
2.5 "generated or uploaded data": We may process any data that you may upload to the Platform, or that you access via the Platform, or which you may generate on the Platform; and
2.6. “unique application numbers”: Certain services include a unique application number. This number and information about your installation (for example, the operating system type and application version number) may be sent to us when you install or uninstall such a service or when that service periodically contacts our servers, such as for automatic updates.
3. When will we process your personal data?
3.1 Personal Information may be Processed by us in several ways, including, when:
- you access or use the Platform;
- you register to use the Platform or create a user account with us;
- you submit any personal data directly to us for any reason; and
- you contact us with any comments or queries.
4. How do we collect your personal data?
4.1. We collect your personal data in two ways, namely:
- actively from you; and
- passively from your Access Device when you use the Platform.
4.2 Active collection from you
- We may require you to submit certain information in order for you to register to use the Platform or when you communicate directly with us, for example via e-mail, feedback forms, site comments and forums.
- If you contact us, we may keep a record of that correspondence.
- The information we may actively collect from you may include your:
. Identifying information (e.g. your name, surname, employment information);
. Contact details (e.g. e-mail address); and
. Any other information which we may request from you from time to time.
4.3 Passive collection from your Access Device
- We passively collect some of your personal data from the Access Device which you use to access and navigate through the Platform, using various technological means, for instance, using server logs to collect and maintain log information.
- The information which we may passively collect from your Access Device may include your identifying information, contact details, Access Device and Access Device event information, activity information, log information, location information, unique application numbers, and any other information which you permit us, from time to time, to passively collect from your Access Device.
5. How We Use Your Information
5.1 Your personal data may be stored and processed by us in the following ways and for the following purposes:
- service functionality and providing access to and operating the Platform;
- to create your account to use the Platform and allow your continued use of the Platform;
- to establish and verify your identity on the Platform;
- to analyse, optimise user experience and improve the Platform
- analysing user behaviour, usage and trends, as well as performing market research;
- to advertise goods and services to you, including on a targeted basis and to create a marketing profile for future advertisements directed to you;
- operate, administer, maintain, secure and develop the Platform and the performance and functionality of the Platform;
- to provide to third parties (such as our service providers) in order to optimise our service to you and the Platform generally;
- to comply with applicable laws and/or to report to the appropriate legal and regulatory authorities;
- managing our relationship with you, including communicating with you and keeping a record of our communications with you and your communications with us;
- informing you about any changes to the Platform, changes to the terms of use applicable to the Platform, this privacy policy or other changes which are relevant to you;
- detect, prevent or deal with actual or alleged fraud, security or the abuse, misuse or unauthorised use of the Platform and/or contravention of this privacy policy or the terms of use that apply to the Platform; and
- for other purposes relevant to our business activities, provided they are lawful.
6. Data Security
6.1 In order to operate the Platform, we may store your personal data in data centres that may be outside your country of residence and where the infrastructure may be owned or operated by our service providers or affiliated companies. If the location that personal data is transferred to or stored does not have substantially similar laws which provide for the protection of personal data, we will take reasonably practicable steps to ensure that your personal data is adequately protected in that jurisdiction.
6.2 We take reasonable technical and organisational measures to secure the integrity of retained information, using accepted technological standards to prevent unauthorised access to or disclosure of your personal data, and protect your personal data from misuse, loss, alteration or destruction.
6.3 We also create back-ups of your information for operational and safety purposes.
6.4 We review our information collection, storage and processing practices, including physical security measures periodically, to ensure that we keep abreast of good practice.
6.5 Despite the above measures being taken when Processing Personal Information, we do not guarantee that your Personal Information is 100% secure.
7. Data Sharing
7.1 As a general principle, we will not intentionally disclose, for commercial gain or otherwise, your personal data other than as set out in this privacy policy or without your permission.
7.2 We may share your personal data in the following circumstances:
- with our affiliates and our service providers;
- with your explicit consent;
- with our professional advisors and banks for the purpose of providing services to us,
- where we are required to disclose your identity for regulatory and legal purposes;
- if we sell any of our business or assets, in which case we may disclose your personal data to the prospective buyer for due diligence purposes;
- if we are acquired by a third party, in which case personal data held by us about you will be disclosed to the third party buyer;
- with third party agents or contractors for the purposes of providing services to us;
- to the extent required by law, for example if we are under a duty to disclose your personal data in order to comply with any legal obligation, establish, exercise or defend our legal rights; and
- to governmental agencies, exchanges and other regulatory or self-regulatory bodies if we are required to do so by law or if we reasonably believe that such action is necessary to:

employees, contractors, suppliers, service providers, agents or any third party;
. Detect, prevent or deal with actual or alleged fraud, security or technical issues or the abuse, misuse or unauthorised use of the Algoboost.ai platform and/or contravention of this privacy policy; and/or
. protect the rights, property or safety of members of the public (if you provide false or deceptive information about yourself or misrepresent yourself as being someone else, we may proactively disclose such information to the appropriate regulatory bodies and/or commercial entities).
8.Retaining your personal data
8.1 We may keep and process some or all of your personal data (even if you cease your access to, or use of, the Platform) if and for as long as:
- we are required or permitted by law or a contract with you to keep it;
- we reasonably need it for lawful purposes related to our functions and activities;
- we reasonably need it for evidentiary purposes; or
- you agree to us keeping it for a specified further period.
11. Keeping your personal data updated and correct
Where required by law, we take reasonable steps to ensure that your personal data is accurate, complete, not misleading, and up to date. You must let us know if any information we have about you is incorrect, incomplete, misleading or out of date, by notifying us at the contact details set out below or by updating your user account on the Platform.
10. User Rights
10.1 Depending on the territory in which you access the Platform, you may have certain rights under applicable data protection legislation in your territory. These rights may include the right to:
- access your personal data or copies of your personal data (in a structured or commonly used format);
- rectify inaccuracies in your personal data (which will be done free of charge, unless the request is manifestly unreasonable or excessive);
- request that your data is deleted, erased or forgotten by us;
- object to our processing of your personal data;
- restrict the processing of your personal data
- personal data portability requiring us to transmit your personal data to a third party where this is technically feasible;
- withdraw your consent to our processing of your personal data, at any time;
- object to the processing of your personal data for marketing; and
- make a complaint to the data protection authority in your jurisdiction.

11. Changes to Privacy Policy
11.1 We may update this Privacy Policy to reflect changes in our data practices at any time. We will give you reasonable notice of any material changes to this privacy policy. By continuing to access and use the Platform you acknowledge and agree to those changes to this privacy policy. Unless otherwise stated, the current version of this privacy policy will apply each time you access the Platform.
11.2 If you do not agree to the changes to this privacy policy, you must end your use of the Platform in the way set out in the Platform user terms and conditions (available at https://www.algoboost.ai/terms-of-service.
